The one bite rule states that a dog owner is responsible for all injuries caused by the dog if the owner already knew the dog would act aggressively in any capacity. If a dog has exhibited prior aggressive behavior, it can be assumed the dog owner was aware that their dog may bite someone. However, if the dog has never exhibited prior aggressive behavior, the dog owner may or may not be held responsible.

The second dog bite law stems from negligence on the part of the dog owner. If a dog owner does not leash a dog and the dog bites, the dog owner is guilty of negligence. However, if a dog is provoked in any way, or someone is intentionally trespassing, the dog owner may not be held fully responsible for injuries sustained.
